These Terms of Service ("Terms") govern your access to and use of any website, telehealth platform, mobile application, or other online service (collectively, the "Site") operated by ZOLY LLC d/b/a ZOLY PT ("ZOLY PT," "we," "us," or "our"). By accessing or using the Site, scheduling an appointment, or purchasing any service from us, you agree to be bound by these Terms and our Privacy Policy/Notice of Privacy Practices. If you do not agree, do not use the Site.

1. Who We Are

ZOLY PT is a cash-pay, telehealth physical‑therapy practice owned and operated in the State of Florida. We offer remote evaluation and treatment services to patients who are physically located in Florida at the time of treatment.

2. Eligibility

• Age. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or receive services. Parents or legal guardians may create accounts and consent on behalf of minors where telehealth PT for minors is permitted.

• Location. You must physically be in Florida during each telehealth session unless you receive written confirmation that we are licensed or otherwise authorized to treat you in the state where you are located.

3. No Medical Advice on the Site

Content on the Site is for informational purposes only and does not constitute medical advice. A provider–patient relationship is formed only when you complete intake, provide informed consent, and are accepted as a patient of ZOLY PT.

4. Appointments, Cancellations & Refunds

• Scheduling. Sessions are booked online on a first‑come, first‑served basis.

• Cancellation policy. For single session/evaluation - 24 hours’ notice required or $35 fee charged.

• Refunds. Fees are non‑refundable once a session is completed; unused prepaid packages refundable within 30 days after last session. If package is purchased and partially redeemed, cancellation will incur single session value.

5. Payments

We accept major credit/debit cards, HSA/FSA cards, and other payment methods as listed at checkout, processed through Stripe or similar HIPAA‑compatible processors. You authorize us to charge your payment method for all fees incurred.

6. Insurance & Superbills

We are an out‑of‑network, cash‑pay provider. Upon request we will issue a superbill that you may submit to your insurer. We make no guarantee of reimbursement.

7. Acceptable Use

You agree not to: 1. Record or livestream any session without prior written consent. 2. Upload or transmit malicious code. 3. Impersonate any person or misrepresent your affiliation. 4. Use the Site for any unlawful or abusive purpose.

8. Intellectual Property

All content on the Site—including text, graphics, logos, and video—is owned by or licensed to ZOLY PT and is protected by U.S. and international intellectual‑property laws. You may not reproduce or distribute our content without written permission.

9. Third‑Party Links & Services

The Site may contain links to third‑party websites (e.g., Zoom, Stripe). We are not responsible for third‑party content or services; your use is at your own risk.

10. Disclaimers

SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

11. Limitation of Liability

To the fullest extent permitted by law, ZOLY PT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising from or related to the use of the Site or services.

12. Indemnification

You agree to indemnify and hold harmless ZOLY PT and its officers, employees, contractors, and agents from any claims, damages, or expenses arising out of your use of the Site, violation of these Terms, or infringement of any rights of another.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida without regard to its conflict‑of‑laws principles.

14. Modifications to the Terms

We may modify these Terms at any time. We will post the updated Terms with a new “Last Updated” date. Continued use of the Site after changes constitutes acceptance.

15. Termination

We may suspend or terminate your access to the Site at our sole discretion for any violation of these Terms or applicable law.
